OpenCards Terms of Service

Version 2026-10-04. A Ukrainian version is published alongside this one. If the two differ, the Ukrainian version prevails.

1. Who we are, and agreeing to these Terms

OpenCards is a test-management service available at opencards.dev. It is operated by ФОП Войтович Ростислав Владиславович, a sole proprietor registered in Ukraine (tax ID / РНОКПП 3521612832; address: вул. Розвадовського, буд. 10, кв. 77, м. Кам'янець-Подільський, Хмельницька обл., 32300, Україна; email: [email protected]) — "we" or "us".

These Terms are a contract between us and you. By signing in to OpenCards you accept them. If you use OpenCards for an organisation — your employer, client or team — you confirm that you may bind that organisation, and these Terms then bind it too; "you" includes it. OpenCards is intended for business and professional use, not for consumers.

Our Privacy Policy explains how we handle personal data and forms part of these Terms.

2. The service

OpenCards lets teams keep test cases, requirements and specifications, plan and record test runs, receive reports from CI, and work with all of this through AI assistants and other MCP clients.

The service is currently free of charge. We may introduce paid plans in the future; we will not charge you for anything without announcing the price in advance and getting your agreement.

The service is provided "as is" and "as available". There is no service-level agreement. We work to keep OpenCards available and your data safe, but we do not promise that it will be uninterrupted, error-free or fit for a particular purpose.

We may change, add or remove features. If we decide to discontinue OpenCards, we will give at least 30 days' notice so that you can take your data out.

3. Accounts and access

  • You sign in with a Google account. Keep it secure: whoever controls it can use your OpenCards account.
  • You are responsible for what happens under your account, including through workspace tokens, CI tokens and AI assistants or other clients you connect. Treat tokens as passwords, and revoke the ones you no longer need.
  • Workspace owners decide who is a member of their workspace and what role they have.
  • You must be at least 16 years old.

4. Acceptable use

You must not use OpenCards to:

  • store or share anything unlawful, or anything that infringes someone else's rights;
  • upload malware or anything designed to harm systems or data;
  • try to access accounts, workspaces or data that are not yours, or probe for vulnerabilities without our written permission;
  • run load, stress or performance tests against OpenCards, or otherwise overload it;
  • use stolen or leaked credentials, or automate sign-ins;
  • reverse engineer the service to obtain other customers' data;
  • put special categories of personal data (health, religion, biometric data and the like) or real customer personal data into test content when test data would do;
  • resell or provide the service to third parties as your own without our written consent.

5. Your content

"Your content" is everything you or your team put into OpenCards: test cases, requirements, specifications, run results, reports, files and comments.

  • You own your content. We claim no rights to it.
  • You give us a limited, worldwide, non-exclusive licence to host, copy, process and display your content only as needed to provide and secure the service for you. It ends when the content is deleted, subject to backup expiry (see the Privacy Policy).
  • You confirm that you have the right to put your content into OpenCards.
  • When your content contains personal data, we process it on your behalf as a processor. A data processing agreement is available on request.

6. Connected services

OpenCards works with services we do not control: Google sign-in, AI assistants and other MCP clients, CI systems, and code hosts such as GitHub, GitLab or Bitbucket. Your use of them is governed by their own terms. When you connect such a service, it receives the data its requests return, and its provider — not us — is responsible for what it does with that data.

7. Suspension and termination

  • You can stop using OpenCards at any time. You can delete your account, and an organisation you own, yourself, or ask us to.
  • We may suspend or close an account or a workspace if it breaches these Terms, puts the service or other users at risk, or if the law requires us to. Where we reasonably can, we will tell you first and give you a chance to fix the problem.
  • A deleted organisation disappears at once for all its members. For 30 days we can restore it at an owner's request; after that its content is permanently deleted. A personal workspace is deleted at once, together with its account. Unless a suspension was required by law or to stop serious harm, we will give you a reasonable opportunity to export your content before it is deleted.
  • Sections 5 (the licence ends as stated there), 8, 9 and 11 survive termination.

8. Our intellectual property, and feedback

OpenCards — its software, design, name and logo — belongs to us or our licensors. These Terms do not give you any right to them other than to use the service.

If you send us ideas or feedback, we may use them freely and without obligation to you.

9. Liability

  • To the extent permitted by law, we are not liable for indirect or consequential losses, lost profits, lost revenue, or loss of data that you could have prevented by keeping your own copies.
  • Our total liability to you for all claims relating to OpenCards in any 12-month period is limited to the greater of the amount you paid us in that period and the equivalent of USD 100.
  • Nothing in these Terms limits liability that cannot be limited by law, including liability for intentional wrongdoing.
  • You will compensate us for losses caused by your content or by your breach of section 4.

10. Changes to these Terms

We publish every version with its date; previous versions remain available at /terms/<date>. If we make a material change, we will show it to you when you next sign in, and you will need to accept it to keep using OpenCards. If you do not accept, you can stop using the service and ask us to delete your account.

11. Governing law and disputes

These Terms are governed by the law of Ukraine. We will first try to resolve any dispute by negotiation; write to [email protected]. A dispute that cannot be resolved this way will be heard by the competent court of Ukraine.

12. Other terms

  • If any part of these Terms is found invalid, the rest remains in force.
  • If we do not enforce a right, we have not waived it.
  • You may not transfer your rights under these Terms without our consent. We may transfer ours to a successor operating OpenCards, and we will tell you if we do.
